The Special Investigations Unit (SIU) has cleared two OPP officers following an investigation into the arrest of a 42-year-old man in Alliston that resulted in a fractured kneecap.
The incident happened on November 17th, 2024, after OPP officers responded to a reported domestic disturbance at an apartment building near Young Street and King Street South. Police were called after a building superintendent reported yelling, slamming doors, and children screaming coming from the residence.
According to the SIU report, officers arrested the man for mischief and escorted him out of the building in handcuffs. Video evidence reviewed by investigators showed the man walking quickly across the parking lot while an officer attempted to slow him down by pulling back on his arm.
During the interaction, the man fell to the ground and later learned he had fractured his left kneecap. He was taken to hospital by paramedics for treatment.
The SIU examined whether the officers used excessive force during the arrest. Investigators reviewed witness interviews, police communications, medical records, and surveillance video from the apartment building.
In his decision, SIU Director Joseph Martino found there were no reasonable grounds to believe either officer committed a criminal offence.
The report states the evidence did not establish that the officer intentionally forced the man to the ground using unlawful force. While there was conflicting evidence about how the fall occurred, the SIU determined the available video did not support claims the man had been kicked in the knee.

The SIU concluded the officer was lawfully attempting to control the man’s movements during the arrest and that the evidence did not support criminal charges.
